MERCED COUNTY DISTRICT ATTORNEY’S SON ALLEGEDLY LINKED TO MARCH 9, 2018 SHOOTING THAT MERCED PD AND MERCED SUN-STAR HAVE BEEN TRYING TO KEEP AWAY FROM THE PUBLIC DURING DA’S RE-ELECTION YEAR
MERCED, CA – Merced PD Report # 18-13641 – On March 9, 2018 at approximately 1:17 AM a call was received at Merced PD Dispatch from a male subject stating that an accidental shooting had occurred on Shady Hollow Court in Merced, CA. The address given by the caller was apparently incorrect, which delayed officer’s response. But one officer had a hunch that the shooting may have happened at a home he was familiar with on Shady Hollow Ct., the home of Andrew Massengale’s father. A home the officer was familiar with because of the family’s alleged gang ties and criminal history in Merced.
The officer called back to dispatch notifying them of the incorrect address and that he was going to knock at the home he suspected. He also requested that dispatch continue to call the reporting party back to confirm the address of the shooting. A female answered this time and after hearing the officers’ knocking she let them into the home. There they found 17-year-old David Hunter Burkhart, the father of a one-year-old child, with at least one gunshot wound. It is still yet unknown to the family if David was DOA or if he was taken to a hospital and later died. And they still do not know where on his body he was shot. They were told it was in the stomach, but are not sure because the Merced PD will not tell them. Though they did confirm they heard rumors that he was hit in the stomach or chest area.
What the Merced PD is telling the family is that a surveillance video from a neighbor’s home shows two men getting out of the front seat of a vehicle and a third getting out of the rear seat. According to the family, police confirmed the front passenger’s identity as Andrew Massengale. The driver could not be clearly identified other than being a white male whom is alleged to be Ethan Morse, the son of Merced County DA Larry Morse II. They also told the family that David was in the rear seat. Detectives also confirmed that both driver and passenger had firearms that were visible in the video. All three then enter the home. Police did not state to the family if David looked distressed or concerned for his safety or if the two men with him were using the firearms to direct David’s compliance to enter the home.
The family also state that the Merced PD are telling them they believe the shooting may have been part of some sort of shooting game. It’s a game played with guns much like Russian roulette. But the problem with this theory is that if the victim was shot in the stomach or chest that would not fit with a game that calls for placing a revolver with only one bullet in the gun to your head, spinning the barrel and pulling the trigger in the hopes it’s not your last move. They believe this because Andrew Massengale told them. Yet how can a known gang member, Andrew, be allowed to keep firearms, have someone shot in his home and not a single person arrested after nearly two months? The family also confirmed that the Merced PD told them it’s taking so long because they have to wait for ballistic results to come in and that only three people were in the home at the time of the shooting naming David, Andrew and Andrew’s father. But the officers’ wont let the family know how and when the yet unidentified driver of the vehicle left or show them the video.
The Merced PD seem to want to consider this shooting a matter not to be disclosed to the public and I wanted to know why. So I called the Merced PD and left a message for Detective Russell requesting any public information that can be released regarding this case must be released immediately to protect the public at large and to inform them of the death. I will update this story once I receive his call.
The family confirmed that David’s body also had bruising on his face and arm, which may be indicative of an assault before the shooting.
Andrew Massengale is notoriously known as the one gang member Merced County Superior Court Judge Ronald Hansen could trust. So much so that he relied heavily on Massengale’s testimony in Ethan Morse’s preliminary murder trial releasing Ethan Morse before a jury of his peers could weigh the evidence and render a just verdict. Ethan Morse is now suing Merced County and the Sheriff’s department in Federal Court for his arrest in the murder of Bernabed Hernandez-Canela.
The family has also confirmed to this reporter that Andrew Massengale, Ethan Morse and David Burkhart hung out regularly, even going to each other’s homes including the Merced County DA’s home recently. David’s family has known Massengale since he was in school with some of them and considered him a family friend. Now they are frightened and filled with so many questions as they watch the Merced PD gather to protect Andrew Massengale and possibly, if he was involved, Ethan Morse.
The Merced Sun-Star and its crackpot reporters have been complicit in this cover-up. They have not even reported the death of David or given the family a platform to speak out regarding this crime and the people involved. The public must demand the truth from its news resources and its police department and they must get it ASAP.
